AGREEMENT TO OUR LEGAL TERMS
The business represented through this website and associated Services is Fisher Tree Service, LLC ("Fisher Tree Service," "Company," "we," "us," or "our"), an Indiana business providing tree services, lawn care, property maintenance, gutter cleaning, land and lot clearing, cleanup, and related services.
The website https://fishertreeservice.com (the "Site"), the Fisher Tree Service mobile application, if applicable (the "App"), and other related digital interfaces through which Fisher Tree Service's services may be accessed are provided through a technology platform owned and operated by TypeOverflow ("TypeOverflow").
The Site, App, and related digital interfaces, together with their underlying software, source code, systems, databases, infrastructure, technical architecture, functionality, and other platform technology, are collectively referred to as the "Platform."
TypeOverflow owns and operates the Platform. Fisher Tree Service, LLC uses the Platform to provide information about and facilitate access to its business and services.
Fisher Tree Service, LLC is responsible for the tree services, lawn care, property maintenance, gutter cleaning, land and lot clearing, cleanup, estimates, scheduling, and other commercial services represented or offered through the Platform.
TypeOverflow is a technology platform provider and is not the provider of Fisher Tree Service's commercial services.
Fisher Tree Service, LLC and TypeOverflow are separate and independent entities. Nothing in these Legal Terms creates a partnership, joint venture, employment relationship, or agency relationship between Fisher Tree Service, LLC and TypeOverflow.
These Legal Terms constitute a legally binding agreement between you and Fisher Tree Service, LLC concerning your use of the Services. Certain provisions of these Legal Terms also expressly confer rights and protections upon TypeOverflow as the owner and operator of the Platform.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to these Legal Terms. If you do not agree to these Legal Terms, you must discontinue use of the Services.
MODIFICATIONS, AVAILABILITY, AND INTERRUPTIONS
We reserve the right to modify, update, suspend, or discontinue all or any portion of the Services at any time, including features, functionality, availability, content, or service offerings, subject to applicable law.
Because the Services are provided through a technology platform owned and operated by TypeOverflow, changes to the underlying website, software, infrastructure, security systems, technical functionality, or other components of the Platform may also occur from time to time. Fisher Tree Service does not control or independently operate the underlying Platform technology.
We may also revise these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the beginning of these Terms. If we make material changes, we may provide additional notice where required by applicable law.
Your continued use of the Services after revised Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law. If you do not agree to the revised Terms, you should discontinue use of the Services.
We do not guarantee that the Services or any particular feature will always be available, uninterrupted, or unchanged. We may suspend or discontinue portions of the Services when reasonably necessary for maintenance, security, legal compliance, technical changes, business reasons, or other legitimate purposes.
1. OUR SERVICES
The Services provide information regarding Fisher Tree Service, LLC and its tree services, lawn care, property maintenance, gutter cleaning, land and lot clearing, cleanup, estimates, scheduling, customer communications, and related services.
The Services are made available through the Platform owned and operated by TypeOverflow.
Information provided through the Services is for general informational purposes and does not necessarily constitute a binding offer, contract, quote, or guarantee that a particular service will be available.
Any estimate, proposal, appointment, or agreement for services may be subject to additional terms provided by Fisher Tree Service, LLC.
2. PLATFORM OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
Platform Ownership
The Platform and its underlying technology are owned by TypeOverflow.
TypeOverflow owns and operates the Platform and its underlying technology, including the software, source code, technical architecture, databases, infrastructure, systems, interfaces, functionality, and designs used to provide the Platform.
Nothing in these Legal Terms transfers ownership of the Platform or its underlying technology from TypeOverflow to Fisher Tree Service, LLC or to you.
Fisher Tree Service, LLC is authorized to use the Platform pursuant to its separate arrangement with TypeOverflow.
Fisher Tree Service Intellectual Property
The Fisher Tree Service name, business identity, trademarks, service marks, logos, photographs, business information, service descriptions, and other materials specifically owned or supplied by Fisher Tree Service, LLC remain the property of Fisher Tree Service, LLC or their respective owners.
Platform Content
Certain content and materials made available through the Platform may be owned by TypeOverflow, Fisher Tree Service, LLC, or third-party licensors.
Ownership of such materials remains with the applicable owner.
Limited User License
Subject to your compliance with these Legal Terms, you are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Services for their intended purposes.
You may not, except as expressly permitted by applicable law or with written authorization from the applicable owner:
Copy, reproduce, modify, or create derivative works from the Platform;
Copy or reproduce Platform source code or software;
Reverse engineer, decompile, disassemble, or attempt to derive source code;
Extract, scrape, or systematically retrieve Platform data or Content;
Sell, sublicense, lease, distribute, or commercially exploit the Platform;
Circumvent technical or security measures;
Remove proprietary notices;
Use the Platform to develop a competing technology platform; or
Otherwise exploit the Platform or its underlying technology without authorization.
All rights not expressly granted are reserved by the applicable owner or licensor.
All ownership rights in the Platform and its underlying technology remain with TypeOverflow and are not affected by the termination or expiration of these Legal Terms.
3. CUSTOMER DATA AND DATA OWNERSHIP
Customer Data
For purposes of these Legal Terms, "Customer Data" means information and business records relating to Fisher Tree Service's customers, prospective customers, leads, inquiries, service requests, estimates, appointments, communications, service history, properties, and related business interactions that are submitted to, collected through, generated within, or maintained through the Platform in connection with Fisher Tree Service's business.
Customer Data may include personal information provided by or relating to customers and prospective customers.
Fisher Tree Service's Rights in Customer Data
As between Fisher Tree Service, LLC and TypeOverflow, Fisher Tree Service, LLC retains its ownership rights and interests in Customer Data to the extent Fisher Tree Service, LLC owns or has rights in such information.
TypeOverflow does not acquire ownership of Customer Data merely because Customer Data is submitted to, stored on, transmitted through, or processed by the Platform.
Nothing in these Legal Terms transfers ownership of Customer Data from Fisher Tree Service, LLC to TypeOverflow.
The rights of customers and other individuals in their own personal information are not affected by this provision and remain subject to applicable law and the Fisher Tree Service Privacy Policy.
License to TypeOverflow
Fisher Tree Service, LLC authorizes TypeOverflow to host, store, copy, process, transmit, back up, secure, maintain, access, and otherwise use Customer Data as reasonably necessary to provide, operate, maintain, secure, troubleshoot, support, and improve the Platform and related functionality.
This authorization includes processing Customer Data through databases, storage systems, backups, hosting infrastructure, communications systems, security systems, analytics systems, and other technical infrastructure operated or arranged by TypeOverflow or its service providers.
TypeOverflow may also access and process Customer Data as reasonably necessary to prevent fraud, abuse, unauthorized access, security incidents, or other misuse of the Platform; comply with applicable law; enforce applicable agreements; respond to lawful requests; and protect the rights, property, or security of Fisher Tree Service, TypeOverflow, customers, users, or others.
The rights granted to TypeOverflow under this Section are limited to the purposes described in these Legal Terms, the Privacy Policy, applicable agreements, and applicable law. They do not constitute a transfer of ownership of Customer Data.
Customer Data and Platform Technology Are Separate
Customer Data and the Platform are separate categories of rights.
Fisher Tree Service, LLC's rights and interests in Customer Data do not give Fisher Tree Service, LLC ownership of the Platform or its underlying technology.
Likewise, TypeOverflow's ownership of the Platform and its underlying technology does not give TypeOverflow ownership of Customer Data merely because the Platform stores, processes, or transmits that information.
TypeOverflow retains all rights, title, and interest in the Platform and its underlying technology, including software, source code, technical architecture, database technology and structures, infrastructure, systems, interfaces, functionality, designs, and platform-level improvements and developments.
Customer Data After Termination
Following termination or expiration of Fisher Tree Service, LLC's use of the Platform, TypeOverflow will provide Fisher Tree Service, LLC with a reasonable opportunity to retrieve or export available Customer Data, subject to any applicable agreement and technical limitations.
Unless otherwise required by law or agreed in writing, Fisher Tree Service, LLC's opportunity to retrieve or export Customer Data will remain available for 30 days following termination or expiration.
After that period, TypeOverflow may delete Customer Data from active systems, subject to applicable legal or contractual retention obligations and ordinary backup, archival, disaster-recovery, security, and technical processes.
Customer Data remaining in backups or archival systems may be retained for a limited period until those systems are overwritten, deleted, or otherwise purged in the ordinary course, provided that such retained data is not used for purposes inconsistent with these Legal Terms or applicable law.
4. FISHER TREE SERVICE AND TYPEOVERFLOW
Fisher Tree Service, LLC is the business responsible for the commercial services represented through the Platform.
TypeOverflow owns and operates the technology platform through which those services are presented and certain interactions with Fisher Tree Service may be facilitated.
TypeOverflow does not provide tree removal, tree trimming, lawn care, property maintenance, gutter cleaning, land clearing, cleanup, or other services offered by Fisher Tree Service, LLC.
Likewise, Fisher Tree Service, LLC does not own the underlying Platform technology merely because the Platform displays Fisher Tree Service's name, branding, information, or services.
Your use of the Platform does not create a service relationship between you and TypeOverflow for Fisher Tree Service's commercial services.
5. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
You have the legal capacity to enter into these Legal Terms;
You are at least 18 years old;
Information you provide is accurate and current to the best of your knowledge;
You will use the Services only for lawful purposes;
You will not interfere with the operation or security of the Platform; and
Your use of the Services will comply with applicable law.
6. PROHIBITED ACTIVITIES
You may not:
Use the Services for unlawful purposes;
Attempt to obtain unauthorized access to the Platform;
Interfere with Platform operations or infrastructure;
Introduce viruses, malware, or malicious code;
Scrape or systematically collect Platform information without authorization;
Use unauthorized bots, crawlers, spiders, scripts, or automated systems;
Reverse engineer, decompile, or disassemble the Platform except where expressly permitted by law;
Circumvent security or access controls;
Copy or reproduce the Platform's software or technology;
Impersonate another person or entity;
Submit fraudulent or misleading information;
Send spam or unsolicited communications through the Services; or
Otherwise misuse the Platform or violate these Legal Terms.
7. USER SUBMISSIONS
You may voluntarily submit questions, comments, suggestions, feedback, photographs, or other information through the Services.
You retain ownership of intellectual property rights you may have in your Submissions.
By submitting feedback or suggestions concerning Fisher Tree Service's services, the Site, or the Platform, you grant Fisher Tree Service, LLC and TypeOverflow a non-exclusive, worldwide, royalty-free license to use that feedback for purposes of operating, maintaining, improving, securing, and developing the applicable services or Platform.
Customer Data submitted in connection with requesting or receiving Fisher Tree Service's services is governed by Section 3 rather than this Section.
Do not submit confidential information unless specifically requested or authorized.
8. THIRD-PARTY SERVICES
The Platform may use or link to third-party services, websites, applications, communications providers, analytics providers, payment providers, hosting providers, storage providers, or other services.
Third-party services are governed by their own terms and policies.
Neither Fisher Tree Service, LLC nor TypeOverflow is responsible for third-party services except to the extent required by applicable law.

The Privacy Policy explains how information submitted through the Services is collected, used, disclosed, stored, and processed.
Because the Services are provided through a technology platform owned and operated by TypeOverflow, TypeOverflow and other technology or service providers may process personal information in connection with providing, maintaining, securing, supporting, and operating the Platform and related functionality.
Personal information submitted through the Platform may be stored in databases, storage systems, backups, and other infrastructure operated or arranged by TypeOverflow or its service providers on behalf of Fisher Tree Service.
Where TypeOverflow processes personal information on behalf of Fisher Tree Service, LLC, such processing is subject to the Privacy Policy, applicable agreements, and applicable law.
10. TECHNOLOGY PLATFORM AND SERVICE PROVIDERS
The Platform is owned and operated by TypeOverflow.
TypeOverflow may provide or arrange the technical infrastructure necessary to operate the Platform, including hosting, software, databases, security, communications infrastructure, form processing, storage, analytics, maintenance, and other technical functionality.
Fisher Tree Service, LLC uses the Platform to conduct and facilitate its business activities.
TypeOverflow and its service providers may store and process Customer Data and other information submitted through the Platform as reasonably necessary to provide, maintain, secure, troubleshoot, support, and operate the Platform and related functionality.
Where TypeOverflow processes personal information on behalf of Fisher Tree Service, LLC, such processing is performed in connection with providing, maintaining, securing, and supporting the Platform and related functionality, subject to applicable agreements, the Privacy Policy, and applicable law.
The ownership or operation of the Platform by TypeOverflow does not make TypeOverflow the provider of Fisher Tree Service's commercial services.
11. GOVERNING LAW
These Legal Terms and your use of the Services are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
12. DISPUTE RESOLUTION
Any legal action arising from or relating to these Legal Terms or your use of the Services shall be brought in the applicable state or federal courts located in Vanderburgh County, Indiana, unless applicable law requires otherwise.
Nothing in these Legal Terms limits rights or remedies that cannot legally be limited or waived.
13. DISCLAIMER
THE SERVICES AND PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW.
FISHER TREE SERVICE, LLC AND TYPEOVERFLOW DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE SERVICES AND PLATFORM, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.
NEITHER FISHER TREE SERVICE, LLC NOR TYPEOVERFLOW WARRANTS THAT THE SERVICES OR PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.
Information provided through the Services may not reflect all conditions applicable to a particular property or service request.
A website estimate or inquiry does not by itself constitute a binding service agreement unless expressly accepted by Fisher Tree Service, LLC.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, FISHER TREE SERVICE, LLC, TYPEOVERFLOW, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PLATFORM.
FISHER TREE SERVICE, LLC'S RESPONSIBILITY FOR ITS COMMERCIAL SERVICES IS DISTINCT FROM TYPEOVERFLOW'S RESPONSIBILITY FOR THE OPERATION OF THE PLATFORM.
TYPEOVERFLOW DOES NOT PROVIDE, PERFORM, OR SUPERVISE FISHER TREE SERVICE, LLC'S TREE SERVICES, LAWN CARE, PROPERTY MAINTENANCE, GUTTER CLEANING, LAND AND LOT CLEARING, CLEANUP, OR OTHER COMMERCIAL SERVICES.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
15. INDEMNIFICATION
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Fisher Tree Service, LLC, TypeOverflow, and their respective officers, directors, employees, agents, contractors, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:
Your violation of these Legal Terms;
Your unlawful use of the Services or Platform;
Your violation of another person's rights; or
Your intentional or unlawful conduct.
16. ELECTRONIC COMMUNICATIONS
Visiting the Services, submitting online forms, sending emails, or communicating electronically with Fisher Tree Service constitutes electronic communication.
You consent to receive electronic communications from Fisher Tree Service when appropriate and agree that electronic notices, disclosures, agreements, and other communications may satisfy applicable legal requirements for written communications where permitted by law.
17. SMS TEXT MESSAGING
Program Description
By separately opting into a Fisher Tree Service SMS messaging program, you expressly consent to receive text messages from Fisher Tree Service, LLC at the mobile number you provide.
Messages may include responses to inquiries, estimate communications, appointment reminders, scheduling information, service updates, and, where applicable, marketing or promotional communications.
SMS consent is not a condition of purchasing goods or services.
Message Frequency
Message frequency varies based on your requests, interactions, appointments, services, and the messaging program to which you have opted in.
Where a specific messaging program provides a stated frequency, that frequency will be disclosed during the applicable opt-in process.
Message and Data Rates
Message and data rates may apply.
Your wireless carrier may charge you according to your mobile plan. Fisher Tree Service, LLC is not responsible for carrier charges, delayed messages, or undelivered messages.
Opting Out
You may opt out of SMS messages at any time by replying STOP.
After you send STOP, you will receive a confirmation message and will no longer receive messages from that messaging program, except where permitted or required by law.

18. MISCELLANEOUS
These Legal Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement governing your use of the Services.
If any provision is determined to be unlawful, void, or unenforceable, that provision will be modified or severed to the extent necessary, and the remaining provisions will remain in effect.
Failure to enforce any provision does not constitute a waiver.
These Legal Terms do not create a partnership, joint venture, employment relationship, or agency relationship between you and Fisher Tree Service, LLC, between you and TypeOverflow, or between Fisher Tree Service, LLC and TypeOverflow.
TypeOverflow is an intended third-party beneficiary of the provisions of these Legal Terms that expressly apply to TypeOverflow, including provisions concerning Platform ownership, intellectual property, Customer Data processing, disclaimers, limitations of liability, indemnification, and misuse of the Platform. TypeOverflow may enforce those provisions directly to the extent permitted by applicable law.
